Privacy is very important to Business4Good. Business4Good wants to inform you as much as possible, protect your personal data and give you control over what happens to your data. You will therefore find below the policy on the collection, storage, use, communication and disclosure of your personal data.

1. Applicability of the Privacy Policy

This Privacy Policy applies to all persons (website visitors, coaching program participants, ...) whose data are processed by Business4Good for the purposes defined in article 5 below.

 Business4Good will update this Privacy Policy from time to time. If Business4Good makes any material changes to the way it collects or processes Personal Data, it will announce such changes in a timely manner. You are bound by any modification to the Privacy Policy as soon as it is published on Business4Good's website, except where such changes are so fundamental that Business4Good considers that it requires your prior express consent

2.1. The following definitions apply:

(1)   Data Subject: the person whose Personal Data are processed by Business4Good.

(2)   Purposes: the purposes for Processing as set out in Article 5 below;

(3)   Business4Good: Business4Good BV, with registered office at Franciskanenlaan 23, 1150 Sint-Pieters-Woluwe, Belgium, registered in the Crossroads Bank for Enterprises under number 0597 665 696 and with e-mail address [email protected];

(4)   Personal data means any information relating to an identified or identifiable natural person ("the data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more elements characterising the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person;

(5)   Processing means any operation or set of operations involving Personal Data or a set of Personal Data, whether or not carried out by automated procedures, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction;

3.  Identity of the controller

Business4Good, with registered office at Franciskanenlaan 23, 1150 Sint-Pieters-Woluwe, Belgium is a controller of your Personal Data because it determines the purposes and means of processing your Personal Data. The processing of your Personal Data is done on the basis of this Privacy Policy.

The Personal Data that you make available yourself to Business4Good are, depending on the case and demand:

  • Business4Good obtains some specific Personal Data as a result of the execution of the agreement, i.e. carrying out coaching sessions via a video conferencing platform:

 

  1. Sound and video recordings
    • Audiovisual recordings of your person, your home, and any other data associated with you at the time of the recording of the coaching session.

 

  1. Data relating to physical and/or mental health [better to keep this paragraph if the possibility exists that participants talk about that]
    • Your physical and/or psychological condition at the time of the intervention

 5. The purposes and legal basis of processing personal data

Business4Good may process the personal data specified above under (a), (b) and (c) of its customers, its customers' employees, and, where appropriate, persons whose personal data it receives through its customers, for the following purposes:

 

  • The provision of our services including their follow-up and invoicing;
  • To keep you informed about Business4Good and our activities (e.g. via a newsletter).

 

The processing is based on the following legal basis:

  • If you are a customer yourself, the processing of the aforementioned personal data by us is necessary for the execution of the agreement concluded between you and Business4Good.
  • If you are an employee of our customer and our customer puts you forward as our contact person, the processing of your personal data is necessary for the fulfilment of our customer’s legitimate interest to communicate with us about our services.
  • The processing and use of e-mail addresses for our electronic newsletters and invitations to activities, is necessary for Business4Good's legitimate interest to provide its already existing customers with information about Business4Good and our activities.

 

Having obtained your electronic contact details as part of our services, we assume that we may use your electronic contact details to inform you about our services, through electronic newsletters. However, with each newsletter, you will be given the opportunity to click an "unsubscribe" link to let us know that you no longer wish to receive such newsletters and/or that you do not wish your data to be processed in the context of such newsletters.

 

  • Visitors to our Website

 

Business4Good processes personal data specified above under (h) from visitors to its website, social media and/or platforms or other channels, when they contact Business4Good or upload information via these means. The data is processed for the following purposes:

 

  • Allow Business4Good to analyse, personalise and optimise the content, operation and security of the Website for the benefit of all Data Subjects;
  • Provide customer support to Data Subjects via email (including answering questions and providing requested information);
  • Maintaining statistics with a view to making them available (whether or not for a fee) to third parties, such as but not limited to professional institutes, government bodies, etc;

 

The processing is based on the following legal basis:

  • The processing of your personal data by us is necessary to pursue Business4Good's legitimate interest in managing its website and optimising its operation
  • Or the unambiguous, free and informed consent (see Cookie Policy [add link])

 

  • Applicants, trainees, employees and interim staff

 

Business4Good may process personal data (a), (c), (d) and (e) of its job applicants, trainees, employees and interim staff, for the following purposes:

 

  • Evaluation of, and communication with, the candidate regarding possible employment with us, as well as drafting an employment agreement.
  • Retaining essential personal data in order to (re)consider your candidature for new vacancies within Business4Good.

 

The processing is based on the following legal basis:

  • The processing of your personal data by us is necessary for the fulfilment of the legitimate interest pursued by us to evaluate and match your profile with our needs.
  • If you reach an agreement with Business4Good on employment, the processing of the aforementioned personal data by us is necessary for the execution of the agreement concluded between you and Business4Good.

 

  • Suppliers (including occasional independent collaborators)

 

Business4Good may process personal data (a), (b) and (c) of its suppliers, the employees of its suppliers, and, where appropriate, persons whose personal data it receives through its suppliers, for the following purposes:

 

  • The ordering, follow-up, monitoring and evaluation of goods and/or services provided by the supplier, the communication between the supplier and Business4Good thereon, and the payment or (if applicable) protest of invoices prepared by the supplier.

 

The processing is based on the following legal basis:

  • If you yourself are a supplier, the processing by us of the personal data defined above is necessary for the performance of the contract concluded between you and Business4Good for the provision of services and/or goods.
  • If you are an employee of a supplier and this supplier puts you forward as our contact person, the processing of your personal data by us is necessary for the fulfilment of the legitimate interest pursued by us to communicate with our supplier.

 

  • Legal purposes

 

In addition, Business4Good may also process your personal data for legal purposes, for instance because of its tax, accounting and social security obligations. The legal basis is then situated in European or national legislation.

 

  • Invocation of legitimate interest

 

We consider that where we invoke a legitimate interest of a third party or of Business4Good, the interests or fundamental rights and freedoms of the persons concerned, do not outweigh this interest.

 

If you have a different opinion, and/or do not want us to process your data for this interest, please do not hesitate to contact us (see infra 8).

 

 

 6.  Categories of recipients

Business4Good transfers your Personal Data to the following categories of recipients in accordance with this Privacy Policy:

 

  • Its independent workers and staff;
  • Processors, engaged for the purpose of a specific assignment (e.g. IT service providers and accountant) and with whom Business4Good has made clear arrangements in an agreement regarding the quality of data processing in accordance with the obligations imposed by the relevant privacy legislation. These processors may only use the data for the purposes determined by Business4Good and in accordance with this Privacy Policy;
    • Personal Data (f) to (g) to other third parties to the extent necessary for the conduct of Business4Good's business and [subject to your consent].

 

  • Notwithstanding the foregoing, Business4Good may need to disclose your personal data:

 

  • To the competent authorities (i) where Business4Good is required to do so by law, on the basis of an express request from these services or in the context of (future) legal proceedings and (ii) to safeguard and defend our rights;

 

  • When substantially all of Business4Good’s assets are acquired by a third party, in which case your personal data will be one of the transferred assets.

 

 7. Retention period

Unless where a longer retention period is required or justified (i) for compliance with a limitation or expiry period provided for by law or (ii) for compliance with another legal obligation, Business4Good retains Personal Data in a format that allows identification of your data for the following period:

 8. Rights of the data subject

 

  • As a data subject, you have a number of rights that you can exercise against Business4Good. If you wish to exercise any of these rights please contact us using the contact details described in this Privacy Policy under 'Identity of the controller'.

 

You have the following rights:

 

  • Right of inspection: you have a right to inspect what type of personal data we collect from you, how we process your personal data and you are entitled to a copy of your personal data.
  • Right to rectification: you have the right to update or rectify inaccurate personal data we process.
  • Right to data erasure: in certain circumstances, you can request that we erase your personal data.
  • Right to restrict processing: you have the right to request that we stop using your personal data in specified circumstances such as if you believe that the personal data we collect about you is inaccurate or that our use of your personal data is unlawful. If you validly exercise this right, we will store your personal data and will no longer process it until this point of discussion is resolved.
  • Right to object: where we rely on our legitimate interests to process your personal data, you have the right to object to this interest.
  • Right to portability: you may ask us to obtain certain personal data you have provided to us in a structured, common and machine-readable form, and you have the right to ask us to transfer your personal data directly to another controller if this is technically possible.

 

In principle, you can exercise these rights free of charge. To do so, you should send a request with a copy of your identity card to us. This is required to prevent any unauthorised disclosure of your personal data.

 

If your request is manifestly unfounded or excessive, we may charge a reasonable fee for the administrative costs associated with your request or we may refuse your request. Moreover, you can only exercise these rights once every six months.

 

In any case, we will always inform you of the action taken on your request within a period of one month at the latest.

 

 

 

 9. Security and Confidentiality of your Personal Data

 

    • Business4Good will take all technical and organisational measures to ensure the security and confidentiality of your Personal Data to avoid the inadvertent, unauthorised or unlawful (i) destruction, alteration, modification or loss of Personal Data and/or (ii) communication of or access to the Personal Data, and/or (iii) ways of Processing.

 

  • Your personal information is stored in secure networks and can only be accessed by a certain number of people, who have specific access rights to these systems, and who are obliged to keep this information confidential.

 

  10. Transfer of Personal Data to Third Countries

 

    • If Business4Good transfers your information outside the European Union, it will take the necessary measures so that your privacy rights remain protected to the same extent as provided for in this Privacy Policy.

 

    In the event that there would be a transfer of personal data outside the EEA to a recipient who is domiciled or established in a country not covered by an adequacy decision issued by the European Commission, such transfer will be governed by a specific transfer agreement that will (i) contain standard contractual clauses, or (ii) be based on any other mechanism under privacy law or any other regulation governing the processing of personal data.
